POSSESSION The act of either actually or constructively possessing or occupying property. ATTORNEY-IN-FACT One who is authorized by another to act in his place under a power of attorney. OPTION An agreement to keep open, over a set period, an offer to sell or purchase property. GIFT TAX A graduated federal tax paid by a donor upon making a gift. ESCROW The process by which money and/or documents are held by a disinterested third person (a "stakeholder") until the satisfaction of the terms and conditions of the escrow instructions (as prepared by the parties to the escrow).
